The agreement between you and Survon, Inc. governing your use of SurvonMD Guardian: your dashboard, Aria, Labs, Family Circle, and Personalized Supplements.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Survon, Inc. ("Company," "we," "us," or "our") governing your access to and use of SurvonMD Guardian (the "Services").
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.
SurvonMD Guardian is a consumer-facing healthcare AI platform, built on the Survon Healthcare Intelligence Platform (SHIP) in partnership with Mayo Clinic, that turns data from your wearables and health apps into personalized insights.
Guardian is offered on two plans:
Aria is our AI assistant. On Guardian Premium, Aria can generate on-demand, plain-language summaries of your health data and, if you subscribe to Personalized Supplements, run an automated monthly analysis to help keep your pack aligned with your trends.
Labs lets you keep lab reports, imaging results, and other health documents alongside your data, and analyze them together with your other health information when you choose to.
Family Circle lets you invite family members, caregivers, a trainer, or your doctor to view a Full data feed or a Weekly digest of your health data. People you invite can only view the information you have shared with them; they cannot edit your data, medications, or care plan.
An optional, separately billed subscription service where Aria proposes a supplements pack based on your Health Profile and recent trends. Nothing ships until you review and confirm your pack. Orders are packed and shipped by our supplement fulfillment partner.
In select regions, we may facilitate access to independent, third-party telemedicine providers. Where offered, these services are governed by the partner provider's own terms and establish a doctor-patient relationship directly between you and that provider, not with Survon, Inc. Availability depends on your location and is not guaranteed.
You may use the Services for personal health insights and wellness monitoring, educational purposes related to health, and sharing your health picture with people you trust through Family Circle.
You may not use the Services to:
All content you upload or generate through the Services must be accurate and not misleading, comply with applicable privacy regulations, respect intellectual property rights, and not contain harmful, offensive, or inappropriate material.
You retain ownership of all content, data, and information you upload or input into the Services ("User Content"), including your Labs documents and Health Profile information. You grant us a limited, non-exclusive license to process, analyze, and store your User Content solely to provide the Services.
You are solely responsible for the accuracy, completeness, and legality of your User Content, and for obtaining any consents necessary before sharing information about yourself with people you invite to Family Circle.
You may not upload or input content that violates applicable law, health information belonging to someone else without their consent, copyrighted material without permission, or false or misleading information.
Our collection, use, and protection of your personal information is governed by our Privacy Policy, incorporated into these Terms by reference.
We process health information in accordance with HIPAA. If you believe a Business Associate Agreement applies to your use of the platform, contact us to discuss.
We implement industry-standard security measures to protect your data, including encryption, access controls, and regular security audits. No system is completely secure, and you acknowledge the inherent risks of data transmission.
You are responsible for confirming the identity and contact details of anyone you invite through Family Circle, and for the consequences of sharing your health data with them. Survon, Inc. is not responsible for how an invited person subsequently uses information you have chosen to share.
The Services, including all software, algorithms, designs, text, graphics, and other content (excluding User Content), are owned by us or our licensors and are protected by intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to access and use the Services in accordance with these Terms. This license does not include the right to modify, distribute, or create derivative works; use our intellectual property for commercial purposes; reverse engineer the Services; or remove proprietary notices.
Any feedback or suggestions you provide about the Services become our property and may be used without compensation or attribution.
Supplement suggestions are wellness-focused and generated automatically. They are not a prescription or treatment plan. Always tell your doctor about any supplements you're taking, especially alongside existing medications or conditions, and check with your doctor or pharmacist before starting anything new.
While we strive for accuracy, we do not guarantee that the Services will be error-free, complete, or suitable for your specific needs. All data patterns and analytics shown in the app must be confirmed and interpreted by your healthcare provider in the context of your complete medical picture.
For medical emergencies, always call your local emergency services immediately. Do not rely on SurvonMD Guardian, Aria, or any of our Services as a substitute for direct emergency contact. Our Services are not designed for, and should not be used in, emergency situations.
Guardian Free is available at no cost. Guardian Premium is billed at $39/month, charged in advance on a recurring basis. Current pricing and plan details are available on our website and are subject to change with 30 days' notice.
Personalized Supplements is a separate, recurring subscription from Guardian Premium, starting at $35/month depending on the contents of your pack. The exact price is shown before you confirm each pack, and nothing ships until you review and confirm it.
You may cancel any subscription at any time. Cancellations take effect at the start of your next billing cycle; we do not provide partial-period refunds except as required by law.
We strive to maintain high service availability but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance when possible. We reserve the right to modify, update, or discontinue any aspect of the Services at any time; material changes will be communicated to users with reasonable notice. You are responsible for ensuring your devices and internet connection meet the technical requirements for accessing the Services.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES DURING THE 12 MONTHS PRECEDING THE CLAIM.
WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
Survon, Inc. is not liable for the acts, omissions, or negligence of independent third parties who provide services connected to the platform, including our supplement fulfillment partner and any telemedicine partner described in Section 2.6. Liability for services provided by those independent parties rests with them, and users seeking recourse must pursue claims directly with the relevant party.
You agree to indemnify, defend, and hold harmless Survon, Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, your violation of these Terms or applicable law, your User Content, or any negligent or wrongful conduct.
You may terminate your account at any time by contacting us or using account settings. Termination does not entitle you to refunds of prepaid fees.
We may suspend or terminate your access to the Services if you violate these Terms or our policies, engage in fraudulent or illegal activity, fail to pay applicable fees, or pose a security risk to our platform or other users.
Upon termination, your access to the Services will cease, we will delete your account data in accordance with our Privacy Policy, and any provisions of these Terms that by their nature should survive will remain in effect.
These Terms are governed by the laws of Delaware, without regard to conflict of law principles.
Before initiating formal legal proceedings, the parties agree to attempt resolution through good-faith negotiations for at least 30 days.
Any disputes not resolved through negotiation shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted remotely via video conference unless all parties agree otherwise.

Users outside the United States are responsible for ensuring their use of the Services complies with local laws and regulations, including data protection requirements. Where telemedicine services are facilitated through independent partners (Section 2.6), those partners are responsible for their own regulatory compliance and licensing; Survon, Inc. does not independently verify partner licensing and is not responsible for a partner's compliance with healthcare regulations or medical practice standards. Availability of any such services varies by location, and users are responsible for confirming they are eligible to receive them where they live.
